Terms and Conditions of Sale
These terms and conditions (these “Terms”) apply to the purchase of a product or a service through www.ambiana-floral.com (the “Site”). These Terms are subject to change by Ambiana LLC (referred to as “Ambiana”, “us”, “we”, or “our” as the context may require) without prior written notice at any time, in our sole discretion. The latest version of these Terms will be posted on this Site, and you should review these Terms before purchasing any product or services that are available through this Site. Your continued use of this Site after a posted change in these Terms will constitute your acceptance of and agreement to such changes.
You may not order services from this website if you:
(A) do not agree to these terms.
(B) are not the older of
(i) at least 18 years of age or
(ii) legal age to form a binding contract with Ambiana,
(C) have a known allergy or sensitivity to any of the products, or intend to use the products in an environment with persons who have a known allergy or sensitivity to any of the products, or
(D) are prohibited from accessing or using the website or any of this website’s contents, goods or services by applicable lay.
- The Ambiana Guarantee
At Ambiana, we are committed to exceptional service and products. If, for any reason, you are not completely satisfied with your purchase or its delivery, please do not hesitate to contact us at email@example.com. We use only a high quality flowers and we maintains quality control over the materials we use to ensure that you can send flowers with confidence.
- Order Acceptance and Cancellation
You agree that your order is an offer to purchase, under these Terms, a product or a service listed in your order. All orders must be accepted by us or we will not be obligated to deliver the floral product or service to you. We reserve the right at any time after receipt of your order to accept or decline your order for any reason. After having received your order, we will send you a confirmation email with your order number and details of the items you have ordered. Acceptance of your order and the formation of the contract of sale between Ambiana and you will not take place unless and until you have received your order confirmation email.
You have the option to cancel your order at any time before we have sent your order confirmation email by sending an email at firstname.lastname@example.org
- Products and Services
All products and services listed on the Site (”Products”), their descriptions, and their prices are each subject to change. Ambiana reserves the right, at any time, to modify, suspend, or discontinue the sale of any Product with or without notice. You agree that Ambiana will not be liable to you or to any third party for any modification, suspension, or discontinuance of any Product. In the event a Product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or Product information received from our suppliers, we shall have the right to decline or cancel any such orders, whether or not the order has been confirmed and/or your card or Venmo account, is charged. If your respective payment method account has already been charged for the order and we cancel your order, we shall immediately issue a refund to your payment method account in the amount of the charge.
The availability of products and services on our site may change at any time, without notice.
Prices are subject to change at any time. By placing an order on www.ambiana-floral.com, you agree to pay the listed price applicable for the product or service (including any sales taxes, surcharges, or delivery fees) at the time of your order, and agree to the terms, restrictions, and conditions of the purchase as of the time you submitted the order. Unless you and Ambiana have agreed to an alternate billing arrangement, we will automatically bill the payment method you submitted during the order process. After placing your order, you will receive a confirmation email.
Posted prices do not include taxes. All such taxes and charges will be added to your merchandise total and will be itemized in your shopping cart and in your order confirmation email
Terms of payment are within our sole discretion and payment must be received by us before our acceptance of an order. We accept all major credit cards and Venmo transfer for all purchases only.
• Shipping Policy
(a) Shipping Option
All orders ship via USPS (US Postal Service) and UPS. Once the package has been shipped, Ambiana is not responsible for loss or damages to items. Please contact USPS or UPS directly for any issues regarding your shipment.
Shipping charges may vary from the amount indicated by the automatic shipping calculator since the weight calculated on the Site may differ from the actual package weight due to the packaging material.
(b) Lead Times
Items are made to order and will ship out within 5 business days after payment has been received for your order. (This policy does not concern the fresh floral arrangements).
Due to the COVID-19 crisis, USPS deliveries are taking a bit longer than usual. We are sorry for this inconvenience and are doing our best to get everything shipped in a timely manner.
(c) Local Pick-Up
Contactless online order pick-up is available from our studio. To pick up your order from our studio, select the No fees field during checkout. We will email you when your order is ready with our location.
(d) Returned Shipments
If your shipment comes back to our studio for any reason, we can ship out again for an additional shipping fee. To avoid returned shipments, please ensure that your shipping address is correct at checkout or get in touch with us before your order ships. Once the shipment goes out the door, we are not able to adjust shipments or delivery addresses.
• Missing | Wrong | Damaged Items
(a) Order Discrepancies
Ambiana takes great care in packing orders. Please check the enclosed packing slip against the actual shipment. However, if the problem persist, please let us know and we will make it right. Any missing items or wrong items must be reported at the following address email@example.com within 3 business days after receiving the order. All sales are deemed final after this delay.
(b) Risk of Loss
All items purchased from our shop are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier. We take no responsibility for the shipment (i.e. in case of lost packages we will not refund anything and/or you shall bear the entire cost of any requested re-shipment). However, we will use reasonable efforts to assist you in tracking the package.
(c) Damaged Items
If your order was damaged upon receipt, please email us a photo of each damaged product and a photo of the package as you received at firstname.lastname@example.org within 3 business days after receiving the order. You also must contact the shipping carrier (USPS, UPS) immediately in order to make a claim as we can not take responsibility for damaged packages. We will then file a claim with the carrier.
• Returns and Exchanges Policy
(a) Online dried flowers & Gift box order
If you are not happy with your Ambiana purchase (dried arrangement or gift box order) for any reason, your return and exchange requests must be sent at email@example.com within 3 days of receiving your order. Requests beyond this time period will not be accepted.
To process a return or exchange an item, items must be in new, unused and untampered condition. The buyer is responsible for paying for return and exchange shipping costs. To qualify for a refund, items must be received back in our studio within two weeks of your original receipt of the package in new, unused condition, in all original packaging. Upon receipt of products, your refund will be credited back to the same payment method used to make the original purchase on the Site. Original shipping charges will not be refunded.
(b) Online fresh flowers order
All our fresh arrangements are meticulous inspected prior to delivery or pick up. Proper care is required. It is the responsibility of the recipient to follow any care instructions provided. Bear in mind that floral products are perishable, we cannot offer refunds of a fresh bouquet after delivery. You are encouraged to inspect our arrangements at the time of pick up or delivery and make us aware of any issues before accepting the arrangement. If you and Ambiana have a disagreement with respect to the acceptable quality of Ambiana’s floral arrangements at the time of pick up or delivery, Ambiana may, at its option, cancel and refund you. Your refund will be credited back to the same payment method used to make the original purchase on the Site.
(c) Gift Cards is one-time transactions that cannot be refunded.
• Delivery Policy
A delivery fee of $20 is applied to all flower orders delivered in DMV Area. However, you can choose to pick-up an order at our design studio in Friendship Heights to avoid this fee. Please select the No Fees field during checkout and we’ll send you our address.
We deliver throughout the DC/MD/VA region between 10am and 7pm 7 days per week. To request a specific delivery time, please type it into the Additional Information field during checkout. Regretfully, we are unable to guarantee time of delivery. We will do our best to accommodate your preferences. You acknowledge that requested delivery dates are non-binding estimates only and that you have no claim against us for any delays or early deliveries.
To ensure that your order will be safe and secure delivered, we reach out to the recipient before delivery. We make every attempt to get the flowers delivered directly to the recipient, or to leave them in a safe place where they can be found when the recipient arrives home. However, in some situations, if there’s no safe space to leave the flowers and the recipient cannot be reached, we may attempt re-delivery the next day (or at another time as agreed upon with the sender if we can reach the recipient to discuss). If we need to attempt re-delivery more than once, we will need to assess an additional delivery charge, or require that the flowers be picked up from our studio. We cannot provide refunds for failed delivery attempts that are beyond our control.
It is the customers responsibility to provide us with the accurate address on which the delivery is to be made. In case of any inappropriateness in the address, we cannot be held liable and hence will not be accountable for any kind of replacement or refund request.
In case the delivery does not reach you at all because of no fault of yours, we will provide replacement or compensation. You are not liable to claim anything else than the amount spent by you.
Ambiana is not responsible for:
• Products delivered to incorrect addresses supplied by the sender.
• Unsuccessful deliveries arising from the recipient not being present at time of delivery at the address supplied by the sender.
• Decreased product quality due to an incorrect delivery address supplied by the sender, or a re-route requested by the sender.
• Product quality problems caused by improper handling by the recipient.
- Substitution Policy
It may be possible that the products (flower and vase) that are displayed on the website may not be present actually due to non-availability of some seasonal flowers or some local restrictions. However, we guarantee the number of flowers to be equal to what is stated on the site. We also guarantee that the quality of the replaced flowers/vase will be same or superior to what is displayed on the website.
• Workshop Terms and Conditions
Ambiana will provide all the materials to make your floral arrangement during the Workshop. Each participant is responsible for following all instructions safety rules and Ambiana could not be responsible in case of injury (Cut…)
(b) Event Times
Ambiana will endeavor to begin and complete the workshop at the times designated at time of purchase, but such times may vary.
(c) Booking a Workshop
Workshop are filled on a first-come, first-served basis. Payment of the Workshop fee is required in order to book your place. Registration and attendance of a Workshop is subject to the capacity limitations of the venue where the Workshop is taking place. You may request a place on the waiting list for a Workshop by sending an email to firstname.lastname@example.org with the date you wish to attend.
(d) Refund policy
Workshop Reservations are Non-refundable. Once you have registered and paid for a Workshop, your payment is non-refundable. There are no exceptions to this rule. However, you are permitted to transfer your reservation to someone else who may attend the Workshop you purchased in your place. Should you choose to do this, you must inform us prior the Workshop at email@example.com by providing the name of the person who will replace you.
(e) Cancellation of Workshop
Ambiana reserves the right to cancel a Workshop for any reason and to reschedule it for a later date. We will inform anyone affected by such cancellation and transfer them into a new class or grant a credit to attend a subsequent Workshop at a later date.
The workshop needs a minimum of 8 persons registered, if less, Ambiana reserves the right to cancel the Workshop and you agree to this uncertainty that comes with attending a Workshop.
• Goods Not for Resale or Export
You represent and warrant that you are purchasing a product or a service from the Site for your own use only, and that the flowers received are not for resale or export.
• Governing Law and Juridiction
All matters arising out of or relating to these Terms are governed by and construed in accordance with the internal laws of the District of Columbia without giving effect to any choice or conflict of law provision or rule (whether of the District of Columbia or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than those of the District of Columbia.
• Limitation of Liability
Because plant products by their nature can be highly allergenic or staining, by ordering our services, you accept the risk of allergic or other adverse reactions by anyone to our delivered plants. Our liability will under no circumstances exceed the actual amount paid by you for a product or service that you have purchased through the site, nor will we under any circumstances be liable for any loss of production, work, data, use, business, goodwill, reputation, revenue or profit, any diminution in value, costs of replacement goods or services, or any consequential, incidental, special or punitive damages or losses, whether direct or indirect. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.
• No Waivers
The failure by us to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision. The waiver of any right or provision will be effective only if in writing and signed by a duly authorized representative of Ambiana.
• No Third Party Beneficiaries
These Terms do not and are not intended to confer any rights or remedies upon any person other than you.
(a) To You. We may provide any notice to you under these Terms by sending a message to the email address you provide or (ii) by posting to the Site. Notices sent by email will be effective when we send the email and notices we provide by posting will be effective upon posting. It is your responsibility to keep your email address current.
(b) To Us. To give us notice under these Terms, you must contact us as follows by sending a message to the email address firstname.lastname@example.org
If any provision of these Terms is invalid, illegal, void or unenforceable, then that provision will be deemed severed from these Terms and will not affect the validity or enforceability of the remaining provisions of these Terms.
